Soulful Shift Academy Agreement

This Agreement (the "Agreement") is entered into between Erica Whalen and Mindful Empower ("Company") and the Participant ("You" or "Participant") regarding your monthly subscription to the

Soulful Shift Academy ("Program"). By purchasing or participating in the Program, you agree to the following terms and conditions:

Monthly Subscription & Renewal

The Soulful Shift Academy is offered on a monthly subscription basis, billed in advance each month. Your subscription will automatically renew each month unless canceled according to the cancellation terms below.

No Refund Policy

All payments made for the Soulful Shift Academy are final and non-refundable. This includes initial and renewal payments. Once access to the Program is granted, no refunds, chargebacks, or reversals of payment will be issued under any circumstances. By subscribing, you agree to this no-refund policy.

Cancellation of Subscription

If you wish to cancel your monthly subscription, please send a cancellation request via email to

[email protected]. Your cancellation will take effect at the end of the current billing period, and you will continue to have access to the Program until the end of that period. To avoid future charges, cancellation requests must be submitted at least 10 days before your next billing date.

Educational Purpose Only

The Soulful Shift Academy provides personal development resources and group coaching for educational purposes only. The Program is not a substitute for professional medical or psychological advice. If you require medical or mental health assistance, consult a licensed healthcare provider or, in case of emergency, contact 911 immediately.

Personal Responsibility

Your participation in the academy requires commitment, effort, and responsibility on your part. While the Program is designed to support your personal growth, the company (Mindful Empower) (Erica Whalen) or any other associated name makes no guarantees of specific results or outcomes, as these are dependent on your individual actions and commitment.

Limitation of Liability

You agree that Erica Whalen, Mindful Empower, and its employees, affiliates, and agents shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your participation in the Program/Academy, including any physical, emotional, or financial losses. This limitation applies to any claims based on contract, tort, or other legal theories, even if the Company/Person/Persons has been advised of the possibility of such damages.

Confidentiality and Respect

As an Academy participant, you agree to respect the privacy and confidentiality of others. You may not disclose, share, or distribute any personal information shared by other participants within the Academy/Group. Doing so may result in legal action

Intellectual Property

All materials, resources, and content provided within the Academy or any other couching within the Academy is the intellectual property of the Company (Mindful Empower) (Erica Whalen). You agree not to reproduce, distribute, or share any Academy/Program content without written permission from the Company (Mindful Empower) (Erica Whalen).

Acceptance of Terms

By subscribing to and participating in the Soulful Shift Academy, you acknowledge that you have read, understood, and agree to the terms and conditions outlined in this Agreement. You further agree that these terms are legally binding and enforceable.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Country/Province of which you reside without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located within [Your Jurisdiction] to resolve any legal matter arising from these Terms or your use of the Site and services. You are to hold no ignorance of the laws governing your Country /Province and if you do not know your governing laws said would suggest to do your do diligence of research.

Termination

We reserve the right, without notice and in our sole discretion, to terminate your account or your

use of the Academy and services and to block or prevent future access to and use of the Academy if you

violate any of these Terms.

Code of Conduct Welcome to Mindful Empower.

We are committed to providing a safe, respectful, and inclusive environment for all visitors and participants on our website and in our services, including coaching sessions, masterclasses, webinars, and any online or offline interactions.

7.Compliance with Laws

- Ensure your actions and behavior comply with all applicable laws and regulations, including but not limited to online conduct, data protection, and privacy laws.

8.Consequences of Violations

- Any violations of this Code of Conduct may result in immediate removal from our services, suspension of your account, or permanent banning from future participation. We reserve the right to take appropriate legal action if necessary.

9.Reporting Violations

- If you experience or witness any behavior that violates this Code of Conduct, please report it immediately to [email protected]

Healing & Trauma Recovery Policy

Healing is deep, delicate work—and it’s not one-size-fits-all. While I am passionate about helping my clients work through past wounds, rewrite their stories, and step into self-compassion and confidence, not every client will be eligible for Healing & Trauma Recovery coaching. My approach is rooted in empowerment and self-discovery, but it is not a replacement for therapy or medical treatment. I work with individuals who are ready to engage in personal growth and transformation in a way that aligns with my coaching methods. For this reason, I carefully assess whether my Healing & Trauma Recovery coaching is the right fit for you before we begin.

Eligibility & Guidelines:

✔️ Clients must be in a stable place emotionally and mentally to engage in this work.

✔️ Coaching is future-focused and designed to support personal empowerment, not diagnose or treat mental health conditions.

✔️ If I feel that deeper therapeutic support is needed, I will kindly refer you to a licensed professional.

✔️ Healing & Trauma Recovery coaching is only available to clients who meet my intake criteria after an initial consultation.

✔️ If at any point I determine that coaching is no longer the best fit for your healing journey, I reserve the right to discontinue trauma-related coaching and guide you toward other resources.
